FOR PROPOSED REVISIONS TO THE SOLID WASTE PROGRAM

Notice is hereby given that a hearing before the Department of Environmental Management of the State of Alabama will be held on Tuesday, September 7, 2021 at 10:00 AM in the Main Hearing Room of the ADEM – Central Office location at 1400 Coliseum Boulevard in Montgomery, to consider proposed revisions and additions to Division 335‑13 of the ADEM Administrative Code (Solid Waste Program).
Revisions to the ADEM Admin. Code div. 335-13 are being proposed to ensure consistency with State and Federal statutes and provide clarification of State requirements for the management of solid waste. These changes include updated language to conform to the revised statute for alternate cover material and minor technical revisions to provide better clarity on regulatory requirements or address regulatory concerns. The provisions for obtaining a permit for landfill units, composting facilities, and coal combustion residual (CCR) facilities were relocated to Chapter 5 to provide a single location for all permitting requirements. Additionally, changes were made to the permit modification process to provide greater public participation for certain types of modifications. The Department is also proposing to correct several typographical and citation errors in the existing regulations.

The public hearing is being held to receive data, views, and arguments from interested persons regarding the proposed rules. Attendance at the hearing is not necessary to present such data, views, arguments, or comments. The same may be submitted in writing, but must be received by the Hearing Officer prior to 5:00 p.m. on Tuesday, September 7, 2021.
