  NOTICE  OF PUBLIC HEARING
  FOR  PROPOSED REVISIONS TO THE VOLUNTARY CLEANUP PROGRAM (VCP)
  DIVISION  335-1 and 335-15, ADEM ADMINISTRATIVE CODE

  Notice is hereby given that a hearing before the Department of  Environmental Management of the State of Alabama will be held on Thursday ,  February 3, 2022, at 9:00 am for the  Division 1 Hearing and 10:30 am for the Division 15 Hearing, both to be held in  the Main Hearing Room at the ADEM – Central Office location at 1400 Coliseum Boulevard  in Montgomery, to consider proposed revisions to Division 335-1 (General  Administration) and Division 335-15 (Voluntary Cleanup Program) of the ADEM  Administrative Code.
  Revisions to  Division 1 of the Alabama Department of Environmental Management (ADEM)  Administrative Code are being proposed to modify and add forms required for the  implementation of the Department’s rules and regulations.  Additional modifications are being proposed to  restructure the Voluntary Cleanup Program fees outlined in Fee Schedule H.  In addition, revisions to the Division 15  Code are being proposed to provide greater public participation for cleanup  remedies in which the proposed final remedy is an Environmental Covenant.  Additionally, changes to the Voluntary Cleanup Program Application are proposed  to improve site identification. The Department is also proposing to make  several typographical and citation corrections in the existing regulations.
Copies of the  proposed rules  are available at a cost of 30 cents per page at each of the  locations listed below.  The summary of  reasons supporting the revisions is available free of charge.  Copies of the proposed rules for Division 15 and the proposed rules for Division 1 and the summary  of reasons for Division 15 and the summary of reasons for Division 1 can also be found on the internet at http://adem.alabama.gov/newsEvents/pubHearings.cnt at no cost.   The public hearing is being held to receive data, views, and arguments  from interested persons regarding the proposed rules.  Attendance at the hearing is not necessary to  present such data, views, arguments, or comments. The same may be submitted in  writing but must be received by the Hearing Officer prior to 5:00 p.m. on Thursday, February 3, 2022.
